Regulations on Establishing Panels Within the CAA Court of Arbitration and Their Meeting Procedure


Adopted by resolution of the plenary session of the CAA Court of Arbitration
on February 24, 2022
 
  • The Regulations of Establishing Panels Within the CAA Court of Arbitration and Their Meeting Procedure (“the Regulations”) are made pursuant to Paragraph 2 of Article 4 of the Rules Governing the Composition and Procedure of the CAA Court of Arbitration.
  • To promote efficiency, the CAA Court of Arbitration (“CAA Court”) establishes the following panels, and confers on each panel the power to review and decide matters stipulated in Paragraph 1, Article 4 of the Rules Governing the Composition and Procedure of the CAA Court of Arbitration:
    • Panel for the review of arbitrator registration: Subparagraph 1;
    • Panel for the appointment of arbitrators: Subparagraph 3;
    • Panel for the amounts in dispute and disputes over arbitrator’s fees: Subparagraphs 5 and 6.
  • Each Panel shall consist of seven to twelve CAA Court members, including one convener designated by the President.
  • Panel meeting (“the Meeting”) shall be chaired by the convener. If the convener is unable to chair, a member of the Panel designated by the convener shall act as chair.
  • The quorum for the Meeting is three members. If the Meeting is attended by three members, the adoption of any resolutions shall be made unanimously, including its chair. If the Meeting is attended by four or more members, the adoption of resolutions shall be made by a majority vote. If a matter cannot be resolved, the convener may submit the matter to the plenary session of the CAA Court for resolution.
  • In the event of equal votes, the chair of the Meeting shall decide. If the affirmative votes and negative votes only differ by one vote, the chair may vote for the minority to reject the resolution on the basis of equal votes.
  • External communications of the Panels shall be made in the name of the CAA.
  • The Regulations shall enter into force upon adoption by the plenary session of the CAA Court. The same shall apply to future amendments.
